Agreement Overview

These Terms and Conditions ("Terms") govern your use of services provided by BestMarietta LLC, doing business as Buzz Branding ("Company," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms.

Service Description

Buzz Branding provides AI-powered customer engagement automation services including:

• Lead capture and nurturing systems

• AI voice and chat agents

• Strategic AEO (Answer Engine Optimization)

• Review and reputation management

• Smart website automation

• Digital loyalty programs

User Accounts and Registration

Account Creation:
You must provide accurate, complete information when creating an account. You are responsible for maintaining account security and all activities under your account.

Authorized Users:
You may designate authorized users to access your account. You remain responsible for all actions taken by authorized users.

Service Packages and Billing

Service Tiers:

• LeadBuzz: $147/month

• BotBuzz: $247/month

• Local Authority Builder: $247/month

• BrandBuzz AI Customer Connect System: $497/month

• Smart Operations Dashboard: $697/month

Payment Terms:

• Services are billed monthly in advance

• Payment is due within 10 days of invoice date

• Late payments may result in service suspension

• All fees are non-refundable except as specified in our refund policy

Price Changes:
We may modify pricing with 30 days' written notice. Changes apply to subsequent billing cycles.

Acceptable Use

You agree not to:

• Use services for illegal or unauthorized purposes

• Interfere with or disrupt service functionality

• Attempt to gain unauthorized access to our systems

• Upload malicious software or harmful content

• Violate any applicable laws or regulations

Data and Content

Your Data:
You retain ownership of data you input into our systems. You grant us license to use this data to provide services.

AI-Generated Content:
Content created by our AI systems belongs to you, subject to our service terms. You are responsible for reviewing and approving AI-generated content before use.

Data Backup:
We maintain regular backups but recommend you maintain independent copies of critical data.

Intellectual Property

Our IP:
All Buzz Branding software, systems, methodologies, and proprietary technology remain our exclusive property.

Third-Party Content:
Our services may include third-party integrations. Use is subject to respective third-party terms.

Service Availability

Uptime:
We strive for 99.9% service availability but do not guarantee uninterrupted service.

Maintenance:
Planned maintenance will be scheduled during off-peak hours with advance notice when possible.

Limitation of Liability

Service Limitations:
Our liability is limited to the amount paid for services in the 12 months preceding any claim.

Excluded Damages:
We are not liable for indirect, incidental, punitive, or consequential damages.

AI Systems:
While our AI systems are sophisticated, you remain responsible for reviewing and approving all AI-generated communications and content.

Indemnification

You agree to indemnify and hold harmless Buzz Branding from claims arising from your use of services, violation of terms, or infringement of third-party rights.

Termination

By You:
Cancel anytime with 30 days' written notice. No refunds for partial months.

By Us:
We may terminate for breach of terms, non-payment, or illegal use with appropriate notice.

Effect of Termination:
Upon termination, you lose access to services. We will provide data export assistance for 30 days post-termination.

Modifications to Terms

We may modify these Terms with 30 days' written notice. Continued use constitutes acceptance of modified terms.

Governing Law

These Terms are governed by Georgia state law. Disputes will be resolved in Cobb County, Georgia courts.

Severability

If any provision is deemed unenforceable, remaining provisions continue in full force.
